But the community is fighting back.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When President Trump assumed office on 20 January, 2025, he began signing a stack of executive orders taking aim at LGBTQIA+ rights, DEI and migrants.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In order to learn more, we\u2019ve compiled a running list of the executive orders targeting LGBTQIA+ rights, as well as a list of the lawsuits challenging these directives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">[Editor\u2019s note: This is a developing story and this article will be updated as and when further developments arise]<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What is an executive order?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Executive orders are a kind of written directive, signed by the president, that orders the government to take certain actions.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it\u2019s worth noting that an executive order doesn\u2019t override the Constitution or federal laws or statues \u2013 but it does set the tone and priorities in policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(Statutes, FYI, come from Congress and are then signed by the president \u2013 but Congress can override vetoes which come from the president.)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>A summary of Trump\u2019s anti-LGBTQIA+ executive orders<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>20 Jan: \u2018<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/01\/30\/2025-02090\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal\">Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government<\/a>\u2019, an executive order which attempts to end legal recognition of trans and non-binary people under federal law, with wide-reaching consequences with regards to single-sex spaces, X gender markers, employment and more.\u00a0It also seeks to house all incarcerated trans women in male prisons and discontinue their access to gender-affirming care.\u00a0<\/li>\n\n\n\n<li>20 Jan: \u2018<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-radical-and-wasteful-government-dei-programs-and-preferencing\/\">Ending Radical and Wasteful DEI Programs and Preferencing<\/a>\u2019, an executive order which targets DEI \u201cmandates, policies, programs, preferences, and activities\u201d throughout federal government.<\/li>\n\n\n\n<li>20 Jan: \u2018<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/reevaluating-and-realigning-united-states-foreign-aid\/\">Reevaluating and Realigning United States Foreign Aid\u2019<\/a>, an executive order that ordered a 90-day freeze on foreign aid spending and handed further control of USAid to Secretary of State Marco Rubio. This has had a major impact on the U.S. President\u2019s Emergency Plan for AIDS Relief (PEPFAR), severely disrupting the provision of HIV-related care globally. On 6 February, Rubio issued an \u201cemergency humanitarian waiver\u201d to allow HIV medication to be distributed abroad.\u00a0However,\u00a0<a href=\"https:\/\/www.unaids.org\/sites\/default\/files\/media_asset\/GHSD_PEPFAR-Limited-Waiver-Approved-Activities.pdf\">a State Department document posted online by UNAIDS on 6 February and then updated on 10 February<\/a>\u00a0indicated that the provision of PrEP would still be restricted, stating: \u201cPre-exposure prophylaxis (PrEP) should be offered only to pregnant and breastfeeding women (PBFW; see section above) during this pause of U.S. Foreign Assistance.\u201d It also noted that: \u201cPeople other than PBFW who may be at high risk of HIV infection or were previously initiated on a PrEP option can not be offered PEPFAR-funded PrEP during this pause of U.S. Foreign Assistance or until further notice.\u201d<\/li>\n\n\n\n<li>27 Jan:\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/prioritizing-military-excellence-and-readiness\/\">\u2018Prioritizing Military Excellence and Readiness\u2019<\/a>, an executive order which takes aim at trans people serving in the military. As of 14 February, the US Army stated that trans people would no longer be able to enlist and that it would no longer perform or facilitate \u201cprocedures associated with gender transition for service members\u201d. Openly trans people were first able to legally serve in the US military from 25 January 2021.\u00a0<\/li>\n\n\n\n<li>28 Jan: \u2018<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-children-from-chemical-and-surgical-mutilation\/\">Protecting Children From Chemical and Surgical Mutilation<\/a>\u2019, an executive order which instructs agencies to block gender-affirming care for those under 18. You can read more about this\u00a0<a href=\"https:\/\/www.gaytimes.com\/justice\/trump-issues-executive-order-to-ban-all-gender-affirming-care-for-minors\/\">here<\/a>.\u00a0<\/li>\n\n\n\n<li>29 Jan:\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-radical-indoctrination-in-k-12-schooling\/\">\u2018Ending Radical Indoctrination In K-12 Schooling\u2019<\/a>, an executive order which directs the Departments of Education, Defense, and Health and Human Services to work with the Attorney General to make a plan to strip funding from schools which promote education \u201cbased on gender ideology and discriminatory equity ideology\u201d and calls for the prosecution of teachers who respect trans children\u2019s gender identities and efforts to socially transition.<\/li>\n\n\n\n<li>5 Feb:\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/02\/keeping-men-out-of-womens-sports\/\">\u2018Keeping Men Out Of Women\u2019s Sports\u2019<\/a>, an executive order which attempts to ban trans women and girls from sports at the school and collegiate level and encourages athletics associations to revise their rules so as to bar trans women from participating in female sporting categories. You can read more about this\u00a0<a href=\"https:\/\/www.gaytimes.com\/justice\/trump-executive-order-trans-women-in-sport\/\">here<\/a>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">https:\/\/www.instagram.com\/p\/DFGNCaqSAHP\/embed\/captioned\/?cr=1&#038;v=14&#038;wp=540&#038;rd=https%3A%2F%2Fwww.gaytimes.com&#038;rp=%2Fjustice%2Flgbt-lawsuits-trump-administration%2F#%7B%22ci%22%3A0%2C%22os%22%3A6464.699999999255%2C%22ls%22%3A2464.4000000003725%2C%22le%22%3A3028.4000000003725%7D<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Lawsuits challenging Trump\u2019s anti-LGBTQIA+ executive orders<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>26 Jan: An incarcerated trans woman, known pseudonymously as Maria Moe, challenged a Bureau of Prisons (BOP) policy which would see her moved to a male prison and her gender-affirming care discontinued, on the grounds that this would expose her to an \u201cextremely high risk of harassment, abuse, violence, and sexual assault.\u201d\u00a0<a href=\"https:\/\/www.glad.org\/cases\/moe-v-trump\/\">Her lawyers via GLAD Law, NCLR, and Lowenstein Sandler LLP filed a complaint in federal district court in Massachusetts<\/a>. On the same day, the court granted a temporary restraining order which would allow her to remain in a women\u2019s facility and retain access to medical care while the court considered further relief.\u00a0<\/li>\n\n\n\n<li>30 Jan:\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.276959\/gov.uscourts.dcd.276959.1.0.pdf\">Three incarcerated trans women, known pseudonymously as Jane, Mary and Sara Doe, sued the Trump administration<\/a>, arguing that the \u2018Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government\u2019 executive order\u2019s directive to discontinue their gender-affirming care and re-house them in male prisons violated the US Constitution and federal law.<\/li>\n\n\n\n<li>4 Feb: After their medical care was disrupted, two trans young adults, and five trans adolescents and their families,\u00a0<a href=\"https:\/\/assets.aclu.org\/live\/uploads\/2025\/02\/pflagvtrump.pdf\">launched a federal legal challenge<\/a>\u00a0to Trump\u2019s \u2018<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/protecting-children-from-chemical-and-surgical-mutilation\/\">Protecting Children From Chemical and Surgical Mutilation<\/a>\u2019 executive order.\u00a0<\/li>\n\n\n\n<li>6 Feb: Lambda Legal and the Human Rights Campaign Foundation\u00a0<a href=\"https:\/\/lambdalegal.org\/case\/shilling-v-trump\/\">filed a federal lawsuit<\/a>\u00a0challenging the constitutionality of the Trump\u2019s administration\u2019s ban on military service by trans people. It was filed on behalf of six actively serving trans service members, a trans person seeking to enlist and Gender Justice League.<\/li>\n\n\n\n<li>7 Feb:\u00a0<a href=\"https:\/\/www.aclu.org\/press-releases\/transgender-and-nonbinary-people-take-trump-to-court-over-passport-restrictions\">Working with the ACLU, seven trans and non-binary people filed a federal lawsuit\u00a0<\/a>challenging the State Department\u2019s refusal to allow changes to gender markers on passports, arguing that this is in violation of their constitutional rights.\u00a0<\/li>\n\n\n\n<li>10 Feb: An incarcerated trans woman, known pseudonymously as Jane Jones,\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.277335\/gov.uscourts.dcd.277335.1.0.pdf\">filed a federal lawsuit\u00a0<\/a>after being temporarily transferred to a male lockup and subjected to solitary confinement. While Jones was returned to the low security women\u2019s camp where she had previously resided, she is seeking a permanent injunction from a judge to prevent being transferred to a male facility in future.<\/li>\n\n\n\n<li>12 Feb: Parker Tirrell and Iris Turmelle, two trans teenagers attending school in New Hampshire, had previously sued state education officials over state law barring their participation from girls\u2019 sports at their public high schools. On 12 Feb, their lawyers at GLAD Law and the ACLU of New Hampshire\u00a0<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nhd.63968\/gov.uscourts.nhd.63968.95.0.pdf\">filed an amended complaint to expand the case nationally<\/a>\u00a0so as to challenge Trump\u2019s \u2018Keeping Men Out Of Women\u2019s Sports\u2019 executive order.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Stay tuned for further updates about the outcome of the above lawsuits.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The US President\u2019s first actions have waged a war on queer rights.
